A trustee is the person or institution responsible for managing the assets held in a trust on behalf of the beneficiaries.

They are legally obligated to act in the best interests of the beneficiaries according to the terms of the trust.


What a trustee does

A trustee is responsible for the management and administration of a trust.

They typically:

  • manage and safeguard trust assets
  • follow the terms set by the settlor
  • make distributions to beneficiaries
  • handle administrative and financial duties

Why a trustee is important

The trustee ensures that the trust operates as intended.

Without a trustee:

  • the trust cannot function properly
  • assets may not be managed or distributed correctly
  • beneficiaries may not receive what they are entitled to

With a trustee:

  • the trust is actively managed
  • responsibilities are clearly assigned
  • beneficiaries’ interests are protected

What a trustee is responsible for

A trustee may be responsible for:

  • managing investments or property
  • keeping records and accounts
  • communicating with beneficiaries
  • making decisions in line with the trust terms

They must act with care and in accordance with legal obligations.


What a trustee does NOT do

A trustee does not:

  • create the trust (this is the role of the settlor)
  • automatically benefit from the trust (unless also a beneficiary)
  • act outside the terms of the trust

Their authority is defined by the trust agreement.


When a trustee is involved

  • after a trust is established
  • throughout the life of the trust
  • until the trust is terminated and assets are distributed
