Survivorship is the right of a surviving co-owner of property to automatically inherit the entire property upon the other owner’s death.

It commonly applies to jointly owned assets, where ownership transfers directly to the surviving party without going through probate.


What survivorship does

It ensures that:

  • the surviving owner automatically receives full ownership
  • the asset does not pass through a will
